It is recommended that the City Council:
1. Reject the bid received for CIP No. 17-657, CDBG No. 601820-17, ADA Sidewalk and Ramp Project; and
2. Authorize Staff to re-advertise for competitive construction bids.

Background:
On January 10, 2017, the City Council adopted a resolution allocating Federal Community Development Block Grant (CDBG) funds for a project that includes for the construction of American with Disabilities Act (ADA) compliant sidewalk curb ramps along Prospect Avenue between 6th and 4th Streets. This work will also relocate obstructions on the sidewalk, such as bus benches and street signs, to provide for an uninterrupted ADA compliant path of travel in the project area.
Analysis:
On Thursday, May 17, 2018, the CDBG Program Manager approved the project plans and specifications for advertising. During this time period, the City Clerk advertised the project on the City website and the local newspaper. During the advertisement period the City received eleven (11) requests for plans and specifications from prospective bidders.
Bids were received and opened by the City Clerk's Office on Thursday, June 14, 2018. One bid was submitted and opened for the subject project. The bid received from Nobest, Inc., in the amount of $194,415 was above the engineer's cost estimate of $120,000.
The City encountered a similar situation on the previous year's CDBG curb ramp project on Hermosa Avenue, receiving one bid well over the engineer's cost estimate. CDBG staff did not agree with an award of contract based on an inadequate number of bids received, and requested that the City re-advertise the project once more. From the project re-advertisement, the City received six (6) bids, including three (3) below the engineer's estimate.
Per CDBG's request, staff recommends rejection of the single bid received for the project and authorization to re-advertise for bids.
Fiscal Implications:
There is no fiscal impact associated with the rejection of the bid.
