It is recommended that City Council approve a Professional Services Agreement with McGowan Consulting (Kathleen McGowan) to administer the City's Municipal Storm Water Management Program in connection with NPDES (National Pollutant Discharge Elimination System) permit requirements for an amount of $76,313.

Background

On November 8, 2012, the Los Angeles Regional Water Quality Control Board adopted the fourth Los Angeles Municipal Separate Storm Sewer System (MS4) National Pollutant Discharge Elimination System (NPDES) Permit (Permit) under the Federal Clean Water Act for discharges within the coastal watersheds of Los Angeles County. The Permit identifies conditions, requirements and programs that municipalities must comply with to protect regional water resources from adverse effects associated with pollutants in storm water and urban runoff.

 

McGowan Consulting (Kathleen McGowan) has been assisting the City of Hermosa Beach with implementing the MS4 Permit requirements since 2006. In 2015, the Beach Cities Watershed Management Group (WMG) submitted an Enhanced Watershed Management Program (EWMP) and Coordinated Integrated Monitoring Program (CIMP) to the Los Angeles Regional Water Quality Control Board (LARWQCB). These programs were approved on April 18, 2016 and November 12, 2015, respectively, and require each city to implement the projects, best practices, and monitoring activities described therein, to achieve pollutant load reductions by the prescribed deadlines.

 

Analysis

The Los Angeles MS4 Permit affects a wide range of municipal functions and operations and requires effective management and coordination of Permit responsibilities across City departments. During FY1819, McGowan Consulting will assist the City in implementing its individual requirements under the Los Angeles MS4 Permit. The proposal (Attachment 1) is based on the regulatory requirements of the current 4th term MS4 Permit and understanding our City’s particular needs. LARWQCB staff have stated that they anticipate the adoption of a new MS4 Permit this year, therefore, it is assumed that the 5th term MS4 Permit will be adopted during FY1819. The level of effort in certain subtasks reflects support for the permit negotiation process but does not assume any significant new effort to implement the 5th term MS4 Permit during FY1819 given the uncertainty of timing and content of the next permit.

 

The scope of work to be completed through this Professional Services Agreement (Attachment 2) is detailed in Attachment 1 and is organized into tasks according to the following Permit program areas:

Task 1 - Stormwater Program Management and Coordination;

Task 2 - Public Information and Participation Program;

Task 3 - Industrial/Commercial Facilities Control Program;

Task 4 - Planning & Land Development and Construction Programs;

Task 5 - Public Agency Activities Program;

Task 6 - Illicit Connection & Illicit Discharge Elimination; and

Task 7 - Pursuit and Implementation of Grant Funding for Stormwater Projects

 

McGowan Consulting will work with staff to coordinate and implement these programs and activities across departments, obtain necessary information to prepare reports, communicate work progress, and inform staff of changing requirements and emerging regulatory and watershed issues.

 

McGowan Consulting also serves as watershed coordinator for the Beach Cities Watershed Management Group. This work is contracted separately through a contract between McGowan Consulting and the City of Manhattan Beach under the Beach Cities’ Memorandum of Understanding for CIMP Implementation (Beach Cities CIMP MOU) that was approved by Council on February 9, 2016 and extended through FY1819. The City’s share of watershed coordination services is 5.50% based on area-share in the watershed, whereas previously McGowan Consulting had provided similar services through 50% cost sharing with Manhattan Beach. Through the addition of cost sharing with the cities of Redondo Beach and Torrance, and Los Angeles County Flood Control District on an area-share basis, the City is receiving McGowan Consulting services at a significantly reduced cost. This work is excluded from this scope of work and the City of Hermosa Beach is invoiced separately by the City of Manhattan Beach.

 

In addition to ensuring the City complies with all of its MS4 Permit requirements, McGowan Consulting has assisted the City in successfully obtaining grant funding for stormwater projects and studies, including:

                     $1,720,800 Prop 50 Clean Beaches Initiative funding for the Hermosa Strand Infiltration Trench (2007).

                     $950,850 Clean Water State Revolving Fund through the ARRA (American Recovery and Reinvestment Act of 2009) funding for the Hermosa Strand Infiltration Trench at the Pier Avenue Storm drain (Phase I) (2009).

*This project won a USEPA PISCES award, a CASQA 2011 Outstanding Stormwater Best Management Practice (BMP) Implementation Award, and a 2010 B.E.S.T APWA Project of the Year Award from the Southern California chapter

                     $1,265,000 Clean Water State Revolving Fund funded through the ARRA (American Recovery and Reinvestment Act of 2009) funding for the Pier Avenue Improvement Project stormwater quality improvement elements.

*This project received the USEPA Region IX 2010 Environmental Achievement Award to the City of Hermosa Beach in the category of “Low-Impact Development for Water Quality”.

                     $100,000 California Coastal Conservancy grant award to conduct the City of Hermosa Beach Infrastructure Vulnerability Assessment to Sea Level Rise (2014).

                     $3,099,400 Prop 13 Coastal Nonpoint Source Control Program funding for the Hermosa Beach Greenbelt Infiltration Project (2017).

                     $546,500 Ocean Protection Council Prop 1 funding request for the Hermosa Avenue Green Street (pending consideration for award).

 

McGowan Consulting has extensive experience as outlined in the Statement of Qualifications (Attachment 3) and has assisted the City in successfully meeting the MS4 Permit requirements since 2006. For these reasons, staff recommend approving the Professional Services Agreement without a formal request for proposals.

 

Fiscal Implications

FY18-19 has $68,250 approved budget for Enhanced Watershed Management Program Development and Implementation (Account Number 161-3109-4201) and $15,000 approved for the Stormwater Outreach Program (Account Number 161-3109-4201). The increase in cost from FY17-18 is attributed to McGowan Consulting assuming the inspection and reporting responsibilities for the Clean Bay Inspection Program (Task 3.2).
