Staff recommends City Council continue this item to its September 12, 2023 Regular City Council Meeting.

Executive Summary:

At its September 13, 2022 meeting, City Council adopted an ordinance to add Chapter 5.80, to allow cannabis delivery into the City from businesses located outside the City. Since that time, staff identified regulations related to commercial cannabis activities and cannabis delivery in Hermosa Beach Municipal Code (HBMC) Title 17 and Chapter 5.80 respectively, which conflict with one another. At its July 18, 2023 meeting, the Planning Commission adopted Resolution 23-09, recommending City Council adopt an ordinance outlining staff recommended changes to Title 17.

 

With this item, staff will also present a resolution amending the Master Fee Schedule to establish a Cannabis Delivery Permit application fee and establishing the rate of fines for an administrative citation under HBMC Section 1.10.040 and a resolution establishing a cannabis business tax rate in accordance with HBMC Section 3.44.050.
